Background:

In response to Colorado’s Environmental Justice Act (House Bill 21-1266) and to reduce pollution in disproportionately impacted communities, the Colorado Air Pollution Control Division (the division) is proposing a rule for adoption by the Air Quality Control Commission (the commission). This rule would require additional permitting, modeling, and/or monitoring for sources of pollution that affect communities of color, low-income residents, and communities already being harmed by pollution. The rulemaking hearing is anticipated to occur in May 2023.
